How Many Documents Require Notarization?

Do you ever wonder how many different types of documents there are that require notarization? Literally thousands! Each state also has their own variation of these documents and different requirements.

Document types:

· Financial Documents such as Mortgage documents, Loan Documents, Financial Statements, Property Deeds.

· Legal Documents such as Advanced Directives, Living Trusts, Executorships, Court Documents, Power of Attorney, Wills and Trusts, Custody and Guardianship Agreements, Legal Affidavits, Bill of Sale, Prenuptial Agreements, Divorce Decrees, Adoption Papers, Lease/Rental Agreements, Vehicle Title Transfers.

· Business Documents such as Articles of Incorporation, Commercial Leases, Employment Contracts, Vendor and Supplier Contracts, Memorandum of Understanding documents, Non-Disclosure Agreements, Operating Agreements, Partnership Agreements.

· Travel Documents such as Passport Applications, Passport for Minors under Age 16 (Form DS-3053), Travel Consent form for Minors, Visa Applications, Apostille Requests.

The list above is not exhaustive.

Notaries have specialized training on many of the documents listed above. We are trained to do the following any time we notarize any document:

· Be very familiar with the Notarial language / Notarial block.
· Verify the signer’s ID to ensure it is valid and not expired.
· In the absence of a valid ID, we will check the ID’s of witnesses. If a signer does not have ID, two creditable witnesses are needed in California if neither witness is known to the notary. Both witnesses must personally know the document signer.
· We ensure that the signer is aware and alert and is not being coerced into signing any document.
· We verify that the document is filled out completely.
· If the document originates in California and is returned to another entity in California, notaries must ensure that the language in the Notarial block is California-compliant. If the language is not California-compliant, the notary will need to attach a California-compliant certificate.
