Google Business Profile

Woo hoo! I'm so excited! I finally found my business when I Googled "Notary Near Me." I rank number 12. Ideally, I would like to be in the top 3. A week ago, I couldn't find myself after looking at more than 50 profiles so this is huge!

Small Business Struggles and Victories

Hey there! So, I wear a lot of hats as a small business owner, you know? Most days, I’m pretty aware of it, but every now and then, that old nine-to-five mindset creeps back in. Like, the other day, I was struggling to figure out how to get an SSL Certificate on my website. My brain was like, "Just call IT, right?" But then it hit me: I am IT! I’m basically everything rolled into one – owner, admin, bookkeeper, social media guru, marketing whiz, client relationship and customer service to name a few.

But hey, good news! I finally sorted out that SSL Certificate mess, which means I can now jazz up my website with appointment-setting features and payment options. Cue the confetti! 🎉 It’s a constant juggling act, but hey, that’s the life of a small business owner, right?

I have to admit that this is MY circus and these are MY monkeys!

Minors traveling without parents or guardians

As we near the summer season, travel plans often come to mind for many individuals. With summer vacations on the horizon, it's important to note that children frequently travel either domestically or internationally without their parents. However, given the unfortunate increase in human trafficking cases, numerous countries now mandate a signed Parental Consent form for minors traveling solo or accompanied by guardians other than their parents, such as grandparents, relatives, or friends.

If you find yourself in need of assistance in obtaining a notarized Parental Travel Consent form for your minor child, I am here to guide you through the process. Please call or text me at 657-203-3071!

Valid ID versus Invalid ID

As a Notary Public, we follow guidance set forth by the California Secretary of State. The California Secretary of State has a list of approved training vendors. The National Notary Association is one of the approved training vendors. According to them, below is a list of acceptable forms of identification:

• State-issued driver's license
• State-issued identification card
• U.S. passport issued by the U.S. Department of State
• U.S. military ID
• State, county and local government IDs
• Permanent resident card, or "green card," issued by the U.S. Citizenship and Immigration Services*
• Foreign passport*
• Driver's license officially issued in Mexico or Canada*
• Digital driver's license*
• ID deemed acceptable to the U.S. Department of Homeland Security*
• Inmate ID issued by the State Department of Corrections or Federal Bureau of Prisons, if the inmate is in state or federal custody*
• Inmate ID issued by a county sheriff, if the inmate is in the custody of the county sheriff*

I just had to turn down a request for a notarization for someone who advised me that their driver license had expired, BUT they had the temporary paper license. An expired driver license is an invalid form of identification. An invalid form of identification paired with a temporary paper license does not equal a valid form of ID.

Additionally, there are senior citizens who no longer drive but a valid form of identification is needed for things like notarizations, purchasing alcohol or traveling. Yes, I did say to purchase alcohol. More and more businesses require ID for people to purchase alcohol regardless of how old they look. It is a really good idea to get a California State ID or ensure you have an unexpired passport if you no longer drive.

Please keep your driver license, state ID or passport up-to-date. If you are looking to get documents notarized and don't have valid ID, I can do it if you provide two credible witnesses. These are people who know you and are willing to take an oath to swear or affirm that they know you.

Alert Signers

So, Notary training may need to be updated to state that signers not only have to be aware and alert but they actually have to be alive! The games people play!

Notary Public versus Signing Agent

You may have noticed that in prior posts, I have mentioned that I am a Notary Public and a Loan Signing Agent.

What sets apart a Notary Public from a Signing Agent?

While both roles require starting as a commissioned notary public, they diverge in their duties. A notary public primarily verifies the identity of individuals signing documents mandated by law. Their responsibility lies solely in confirming identities and affixing a notary seal for authentication, without delving into the contents or legality of the paperwork.

On the other hand, a notary signing agent takes on a more specialized task, particularly in the realm of real estate transactions. They oversee the entire process of executing documents related to mortgages. This involves meticulously reviewing loan packages with borrowers, ensuring correct placement of signatures, and proper notarization in accordance with legal requirements.

Transitioning from a notary public to a notary signing agent necessitates additional certification, varying by state. This additional qualification equips them to handle the complexities of real estate transactions with proficiency and compliance.

Document Preparation

In California, it is illegal for Notaries who are not attorneys to help other persons prepare documents, especially important documents like yours that have legal ramifications. Additionally, a Notary cannot explain words or phrases in the document or give you advice about how to proceed or how to fill out blank spaces in the document. The Notary is actually prohibited by state law from doing so. This is called the unauthorized practice of law.

A Notary is authorized to identify the document's signer, give you an oath (if required), make a journal entry of the notarization, and ascertain your willingness to sign and fill out a Notary certificate at the end of the document. Anthing more is taboo.

If you need help filling out your document, call the office that gave you the document, or the office where you will file it.

How Many Documents Require Notarization?

Do you ever wonder how many different types of documents there are that require notarization? Literally thousands! Each state also has their own variation of these documents and different requirements.

Document types:

· Financial Documents such as Mortgage documents, Loan Documents, Financial Statements, Property Deeds.

· Legal Documents such as Advanced Directives, Living Trusts, Executorships, Court Documents, Power of Attorney, Wills and Trusts, Custody and Guardianship Agreements, Legal Affidavits, Bill of Sale, Prenuptial Agreements, Divorce Decrees, Adoption Papers, Lease/Rental Agreements, Vehicle Title Transfers.

· Business Documents such as Articles of Incorporation, Commercial Leases, Employment Contracts, Vendor and Supplier Contracts, Memorandum of Understanding documents, Non-Disclosure Agreements, Operating Agreements, Partnership Agreements.

· Travel Documents such as Passport Applications, Passport for Minors under Age 16 (Form DS-3053), Travel Consent form for Minors, Visa Applications, Apostille Requests.

The list above is not exhaustive.

Notaries have specialized training on many of the documents listed above. We are trained to do the following any time we notarize any document:

· Be very familiar with the Notarial language / Notarial block.
· Verify the signer’s ID to ensure it is valid and not expired.
· In the absence of a valid ID, we will check the ID’s of witnesses. If a signer does not have ID, two creditable witnesses are needed in California if neither witness is known to the notary. Both witnesses must personally know the document signer.
· We ensure that the signer is aware and alert and is not being coerced into signing any document.
· We verify that the document is filled out completely.
· If the document originates in California and is returned to another entity in California, notaries must ensure that the language in the Notarial block is California-compliant. If the language is not California-compliant, the notary will need to attach a California-compliant certificate.

My Office

Even though I'm a mobile notary who travels to her clients, I still have an office.

I have spent the last week putting together my workspace. I destroyed the desk I originally ordered so I returned it and got something easier to assemble. I am waiting on one more file cabinet so I have a place to put my dual tray printer so I can print out loan docs. I went with a pink and white theme this time. The inspiration for that is my pencil cup. I totally changed out the desk and file cabinets that I had when I worked at my corporate job (last two pictures).
